Agreement to Terms

By downloading, installing, or using PequeJuega (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

The App is intended for use by children ages 2-6 under parental supervision. Parents or guardians are responsible for their children’s use of the App.

Description of Service

PequeJuega is an educational game application designed to help young children (ages 2-6) learn through play. The App includes:

• Educational mini-games covering vocabulary, numbers, colors, shapes, and more
• Spanish language content (Latin American Spanish)
• A sticker collection reward system
• A parental dashboard for monitoring usage

User Accounts

PequeJuega does not require user accounts or registration. All progress is stored locally on your device.

In-App Purchases

Free and Premium Content

The App offers:

• Free content: Three topic areas (Farm, Colors, Shapes) available at no cost
• Premium content: Additional topic areas available through a one-time in-app purchase

Purchase Terms

• In-app purchases are processed by Apple (App Store) or Google (Play Store)
• All purchases are final and non-refundable, except as required by applicable law
• Prices are displayed in your local currency and may vary by region
• You must have a valid payment method associated with your App Store or Play Store account

Restoring Purchases

If you reinstall the App or switch devices, you can restore previous purchases through the App’s settings at no additional cost.

Refunds

Refund requests must be directed to Apple or Google, as they process all payments:

• Apple: reportaproblem.apple.com
• Google: play.google.com/store/account

Acceptable Use

When using the App, you agree not to:

• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App for any illegal purpose
• Attempt to circumvent any security features or access restrictions
• Redistribute, sell, or sublicense the App
• Use automated systems or bots to interact with the App

Intellectual Property

Our Content

All content in PequeJuega, including but not limited to:

• Games and game mechanics
• Images, illustrations, and animations
• Audio files and music
• Text and translations
• The App’s design and user interface

is owned by Roger Castells or licensed to us, and is protected by copyright, trademark, and other intellectual property laws.

Your Rights

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes on devices you own or control.

Parental Supervision

PequeJuega is designed for young children and should be used under parental supervision. Parents and guardians are responsible for:

• Monitoring their children’s use of the App
• Managing screen time
• Approving any in-app purchases (via device settings)
• Reviewing the parental dashboard (accessible through a parental gate)

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF CONTENT

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROGER CASTELLS SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, OR GOODWILL
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE PAST 12 MONTHS.

Indemnification

You agree to indemnify and hold harmless Roger Castells from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.

Changes to the App

We reserve the right to:

• Modify, update, or discontinue any part of the App
• Add or remove features
• Change pricing for future purchases (existing purchases are not affected)

We will make reasonable efforts to notify users of significant changes.

Changes to These Terms

We may update these Terms from time to time. Changes will be effective when posted. Continued use of the App after changes constitutes acceptance of the new Terms.

The “Last updated” date at the top indicates when these Terms were last modified.

Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

Governing Law

These Terms are governed by the laws of Spain, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Spain.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
